Amendments to Legislation 2010

The States of Guernsey approved some important amendments to the money laundering legislation which commence from the 24th March 2010.

Terrorism and Crime Law

This Ordinance makes some changes to the Disclosure regime. Amends prejudicing an investigation and enacts provisions of International conventions and other instruments.

Disclosure Law

This Ordinance makes some changes to the Disclosure regime taking into account the recent Shah vs. HSBC judgement in the UK. Amends prejudicing an investigation section and other minor amendments

Drug Trafficking Law

This Ordinance makes some very significant amendments to the money laundering legislation removing the clause " for the purposes of avoiding prosecution for a drug trafficking offence or the making or enforcement in his case of a confiscation order" in section 57. Also amending section 59 making it an offence under this section to launder your own money. It also makes some minor amendments to the disclosure provisions.

Criminal Justice Law

This Ordinance makes some very significant amendments to the money laundering legislation removing the clause "for the purposes of avoiding prosecution for criminal conduct or the making or enforcement in his case of a confiscation order" in section 38. Also amending section 40 making it an offence under this section to launder your own money. It also makes some minor amendments to the disclosure provisions.

Cash Controls Law

The addition of postage stamps to the definition of cash.
