SYRIA (Council Regulation (EC) No 36/2012)

Council Regulation (EC) No 36/2012, as implemented by the Syria (Restrictive Measures) (Guernsey) Ordinance, 2012, the Syria (Restrictive Measures) (Alderney) Ordinance, 2012 and the Syria (Restrictive Measures) (Sark) Ordinance, 2012, has been amended by Council Regulation (EU) No 2016/2137.

The effect of the amendments, which are automatically effective in the Bailiwick, is to permit access to funds or economic resources and the purchase and transport of oil and petroleum products in Syria (together with the related provision of financing or financial assistance), where this is necessary for the purpose of providing humanitarian relief in Syria or assistance to the civilian population in Syria. The amendments also permit the purchase and transport of oil and petroleum products in Syria, and the related provision of financing or financial assistance, for the official purposes a diplomatic or consular mission. 

The Regulation expressly states that these amendments do not affect compliance with Council Regulations 2580/200, 881/2002, and 2016/1686, which deal with combatting terrorism and the Isil (Da'esh) and Al-Qaida organisations respectively, and which have also been implemented in the Bailiwick.

 

MEASURES WHICH SHOULD BE TAKEN

All businesses must familiarise themselves with the legislation and check whether they have any kind of relationship that may relate to prohibited activity. They must report any findings to the Policy and Resources Committee immediately. Businesses must also refrain from any form of direct or indirect involvement in transactions that come within the prohibitions other than in respect of transactions that come within a permitted derogation and have been authorised by the Policy and Resources Committee.

The information referred to above is required by the Policy and Resources Committee in the exercise of its powers under the Schedule to each of the Ordinances listed above.
